Explicit Consent Statement

This Explicit Consent Statement has been prepared under Law No. 6698 on the Protection of Personal Data (“KVKK”) in order to obtain the data subject’s freely given explicit consent, solely for the optional personal data processing activity on the Müzik Hackathon website that is expressly described below.

This text does not replace the KVKK Privacy Notice. The Müzik Hackathon KVKK Privacy Notice is provided to the data subject separately. Giving explicit consent is not a condition for joining the Platform, applying to the competition, having an application evaluated, using account security services, or using core services that do not require consent.

1. DATA CONTROLLER

Under the KVKK, the data controller is T.C. Konya Büyükşehir Belediyesi (the “Municipality” or the “Data Controller”), which runs the Müzik Hackathon event as part of Genç Kültür Kart. The project contact address is Bosna Hersek, Osmanlı Cd. No: 2, 42250 Selçuklu/Konya.

2. CORE OPERATIONS CARRIED OUT WITHOUT EXPLICIT CONSENT

The following activities rely on the legal grounds set out in Article 5(2) of the KVKK, depending on the processing activity concerned: creating and managing a membership account; using the Turkish ID number for verification and matching purposes, to the extent required by the membership and competition processes; phone and email verification; receiving and evaluating a competition application; review of the demo link by the authorised organisation team and the jury for the purpose of evaluating the application; ensuring account and transaction security; keeping records of agreements and approvals; meeting legal obligations; and the retention operations described in the KVKK Privacy Notice. No explicit consent is requested for these activities under this text.

This Explicit Consent Statement does not constitute a transfer of economic rights, a licence, a publication permission, or a permission to use audio or video material in relation to a user’s works, compositions, lyrics, performances, demos, sound recordings or other intellectual products. Where necessary, such matters are governed by the Competition Rules and/or by separate work, performance, recording and broadcast documents.

3. OPTIONAL PROCESSING ACTIVITY SUBJECT TO EXPLICIT CONSENT

If explicit consent is given, the limited personal data listed below may be processed in order to identify culture, arts and music events, workshops, programmes and similar opportunities that match the user’s interests within the scope of Müzik Hackathon and Genç Kültür Kart, to personalise the content and announcements presented to the user according to those interests, and to create user segments for these purposes:

• Music profile information: how long the user has been involved in music, instrument, vocals, songwriting, composition, arrangement, production, recording/mixing, DJing, band experience and similar music profile information provided by the user on an optional basis.
• City and age group information: the city where the user lives and the age or age group derived from the date of birth.
• Limited information about event and application history: the types of events and applications the user has taken part in within Müzik Hackathon and Genç Kültür Kart, team and role information, and participation preferences, to the extent needed to personalise content.

Turkish ID numbers, passwords, SMS verification codes, detailed transaction security logs and the demo content submitted with an application are not included in this optional personalisation activity.

4. PURPOSE AND SCOPE OF PROCESSING AND RECIPIENT GROUPS

Personal data subject to explicit consent is processed only for the personalisation purpose described above, and in a way that is connected, limited and proportionate to that purpose. The data may be processed by the authorised units and staff within the Municipality who run the Müzik Hackathon and Genç Kültür Kart processes within their duties and powers, and — only to the extent needed to deliver the technical service — by software, hosting, database, maintenance and information security providers acting as data processors.

This explicit consent does not permit personal data to be sold or transferred to independent third parties for marketing purposes. If a separate operation requires personal data to be transferred abroad, the conditions in Article 9 of the KVKK are assessed separately; this Explicit Consent Statement cannot on its own be used as a general and ongoing permission for international data transfers.

5. SEPARATE FROM CONSENT TO COMMERCIAL ELECTRONIC MESSAGES

This explicit consent is not consent to receive commercial electronic messages by SMS, email or similar channels. Where the sending of commercial electronic messages requires separate consent under the applicable legislation, that consent is obtained through a separate opt-in field and record mechanism. Giving explicit consent does not mean that consent to commercial electronic messages has been given; equally, consenting to commercial electronic messages does not mean consenting to the personalisation activity covered by this Explicit Consent Statement.

6. GIVING EXPLICIT CONSENT FREELY AND WITHDRAWING IT

Explicit consent is optional. A user’s choice not to give explicit consent, or to withdraw it later, does not in itself prevent the creation or continuation of a membership account, the right to apply to the competition, or the use of core Platform services that are not based on explicit consent.

The user may withdraw explicit consent at any time through the preference management area on the Platform, where such an area is provided, or through the data controller application channels set out in the KVKK Privacy Notice. Withdrawal does not retroactively affect the lawfulness of processing carried out on the basis of explicit consent before the date of withdrawal.

If explicit consent is withdrawn, the personalisation activity based on that consent is stopped. User segments, preference profiles and similar derived records created solely for this purpose are deleted, destroyed or anonymised, to the extent that no other legal ground for processing applies. Membership, competition, security, legal transaction and retention records may continue to be processed within the framework of the other legal grounds and retention periods set out in the KVKK Privacy Notice.

7. USERS AGED 15–17

For users who have not yet turned eighteen (18), where the processing subject to explicit consent legally requires the approval of a legal representative, the user’s electronic declaration alone is not accepted as sufficient; the approval of a parent, guardian or other legal representative may also be requested and verified. Data relating to the legal representative is processed only to the extent needed to carry out and evidence the representation and approval process.

8. DECLARATION OF EXPLICIT CONSENT

The declaration below must be presented as a choice separate from the KVKK Privacy Notice and from acceptance of the User Agreement. The selection field must not be pre-ticked, and a user who does not give explicit consent must not be blocked from membership or from applying to the competition.

For explicit consent given electronically, the version of the text, the choice made, the date and time and the related transaction records may be logged in order to evidence that consent was given, withdrawn or changed, within the framework of the legal grounds and retention periods explained in the KVKK Privacy Notice.
