This Agreement sets out the membership and platform usage terms for users who create an account on the Müzik Hackathon website. Separate dedicated documents apply to competition participation, rights in works, performances, recordings and publication, the processing of personal data, and the use of cookies.

ARTICLE 1 - PARTIES, PURPOSE AND FORMATION OF THE AGREEMENT

1.1. This Müzik Hackathon User Agreement (the "Agreement") is concluded electronically between Genç Kültür Kart, operating at Bosna Hersek, Osmanlı Cd. No: 2, 42250 Selçuklu/Konya (hereinafter "GKK"), and the natural-person user who creates a membership account on the Müzik Hackathon website (the "User").

1.2. The purpose of this Agreement is to govern the User's membership of the Platform, the use of the account, access to the digital services offered as part of membership, and the rights and obligations of the parties arising from this relationship.

1.3. The User acknowledges that the Agreement is made available on the registration screen and that, if the User completes registration by reading and considering its terms and then ticking the box "I have read and accept the User Agreement", the Agreement becomes binding on the User.

1.4. Acceptance of this Agreement does not mean that a competition application has been accepted, that competitor status has been granted, that the User has reached the final, or that any prize or other right has been obtained. Participation in the competition is governed by the separately published Müzik Hackathon Competition and Participation Rules.

ARTICLE 2 - DEFINITIONS

Platform: the Müzik Hackathon website, the member panel, the application screens and all related digital services.

GKK: Genç Kültür Kart, which operates and/or arranges for the operation of the Platform within the scope of Müzik Hackathon.

User/Member: the natural person who creates a valid membership account on the Platform.

Legal Representative: for a User under the age of eighteen (18), the person authorised under applicable law to represent the User as parent or guardian.

Account: the membership area created specifically for the User and accessed through identity/contact verification.

Access Credentials: the password, SMS verification code and similar authentication tools.

Content: text, images, audio, demos, files, links and other data entered, uploaded, linked or transmitted by the User on or through the Platform.

Competition Rules: the separate document governing the conditions for applying to and taking part in the Müzik Hackathon competition.

KVKK Privacy Notice: the privacy notice published on the Platform regarding the processing of personal data.

ARTICLE 3 - SUBJECT MATTER AND SCOPE OF THE AGREEMENT

3.1. This Agreement covers the creation and management of a membership account, logging in to the Platform, profile and account operations, creating a group and inviting members, access to the application screens, tracking application status, viewing workshop and event announcements, and similar membership services offered through the Platform.

3.2. Application, elimination, jury, evaluation, venue rules, prizes and disqualification provisions relating to the Müzik Hackathon competition are set out in the Competition Rules. Where the Competition Rules and this Agreement differ on a matter specific to the competition, the Competition Rules prevail on that matter.

3.3. Authorship of works, performers' rights, audio and video recording, arrangement, mixing/mastering, phonograms, digital distribution, communication to the public, promotion and similar intellectual property matters are not the subject of this Agreement. Where necessary, these matters are governed by the Competition Rules and/or a separate written protocol on works, performances, recordings and publication.

3.4. This Agreement remains in force for as long as the User's membership is active. Termination of membership does not affect provisions that by their nature must continue to apply after termination, such as those on personal data retention, intellectual property, liability and dispute resolution.

ARTICLE 4 - MEMBERSHIP AND ACCOUNT CREATION

4.1. A person who wishes to use the Platform's services may create a membership account by entering the information requested on the registration screen completely and truthfully, completing the mandatory verification steps, and accepting this Agreement.

4.2. The full name, Turkish ID number, e-mail address, telephone number, date of birth, city and music profile details requested on the registration screen, together with any other information that may be required given the nature of the Platform, must be accurate, current and belong to the User. The purposes and legal grounds for processing personal data are explained in the KVKK Privacy Notice.

4.3. It is prohibited to create more than one account using misleading information, to use another person's identity or contact details, to take over another person's account, or to allow a third party to use one's own account.

4.4. To become a member of the Platform, the User must be at least fifteen (15) years old. No membership account may be created on behalf of a person under the age of fifteen (15).

4.5. A User under the age of eighteen (18) may register only with the knowledge and consent of their Legal Representative. Such a User declares truthfully and completely, during registration, that their Legal Representative consents to the membership and to the use of the Platform on the terms set out in this Agreement. If the User makes a false declaration in this respect, GKK may suspend or terminate the membership; the User's liability arising from their own acts and fault is reserved to the extent permitted by law.

4.6. For Users under the age of eighteen (18), GKK may require verification of the Legal Representative's consent, the Legal Representative's contact details, or a separate electronic or physical consent document before continuing the membership, applying to the competition, taking part in physical events, processing prizes, making audio/video recordings, or carrying out other transactions with distinct legal consequences. Where the law requires the consent of a Legal Representative, a unilateral declaration by the User alone cannot be construed as a substitute for that consent.

4.7. Membership is free of charge. GKK expressly states that opening a membership account cannot be construed as a commitment to admission to the competition, a prize, studio services, mentoring or participation in other events.

ARTICLE 5 - ACCOUNT SECURITY AND ACCESS CREDENTIALS

5.1. The User is responsible for keeping their password, SMS verification code and other Access Credentials confidential, for not sharing them with third parties, and for taking reasonable security measures to prevent unauthorised access to their account.

5.2. If the User becomes aware of unauthorised access to their account, suspicious activity, or that their Access Credentials have become known to third parties, the User must notify GKK without delay through the contact channels indicated on the Platform.

5.3. In order to protect account security, GKK may apply reasonable security measures such as password renewal, SMS/e-mail verification, temporary access restrictions and similar steps.

ARTICLE 6 - ELECTRONIC TRANSACTION PROCESS AND AGREEMENT RECORDS

6.1. Before the membership process is completed, the User is given the opportunity to access and review the text of the Agreement and, where necessary, to correct data entry errors.

6.2. The version of the Agreement accepted, together with the date and time of acceptance, may be recorded in accordance with applicable law and linked to the membership account and transaction security logs. So that the accepted version remains accessible and storable, the Platform provides a means of viewing/downloading it, or the relevant version may be sent to the User through an electronic channel that qualifies as a durable medium.

6.3. GKK may retain electronic transaction and membership records for the periods required by applicable law and its legal obligations. The processing of those parts of these records that constitute personal data is carried out as described in the KVKK Privacy Notice.

6.4. Subsequent amendments to the Agreement do not invalidate the records of a previously accepted version. Where an amendment creates substantive new obligations for the User, electronic acceptance is obtained again to the extent required by law or by the nature of the amendment.

ARTICLE 7 - RIGHTS AND OBLIGATIONS OF THE USER

7.1. The User shall use the Platform only for purposes consistent with the law, the rules of good faith, this Agreement, the Competition Rules and the usage rules published on the Platform.

7.2. In particular, the User shall not:

  • Impersonate another person, use another person's identity or contact details, or make false declarations.
  • Disrupt the operation of the Platform; use malicious software, automated queries, bots or unauthorised data scraping, probe or exploit security vulnerabilities, or attempt to bypass access controls.
  • Use the Platform to transmit content that is unlawful, misleading, threatening, insulting or discriminatory, or that infringes the personal, intellectual property or other rights of third parties.
  • Act in ways intended to manipulate the application, evaluation or prize processes, to gain an unfair advantage through multiple accounts, or to falsify system records.
  • Copy, reproduce, reverse engineer, distribute or commercially exploit the Platform's software, interface or content without authorisation.

7.3. The User shall provide the information and corrections that GKK reasonably requests for security, legal compliance or account verification purposes, within a period appropriate to the nature of the request.

ARTICLE 8 - CREATING GROUPS AND COMPETITION APPLICATIONS

8.1. The Platform may allow the User to create a group, invite other members to that group, and submit a competition application on behalf of the group through the application wizard. These actions are subject to the team and application rules set out in the Competition Rules.

8.2. Being the group's contact person or group leader gives the User authority only to carry out group and application operations on the Platform. Unless there is an express and legally valid specific authorisation, the group leader shall not be deemed to have transferred, waived, licensed or otherwise disposed of the other members' personal data, authorship, performers' rights, industrial property rights or other rights attached to the person.

8.3. Where an application requires information about other group members, the User making the application declares that they obtained this information lawfully and ensured that the individuals concerned were duly informed. Where necessary, GKK may request separate verification, declarations or acceptances from the other group members.

ARTICLE 9 - CONTENT PROVIDED BY THE USER AND THIRD-PARTY RIGHTS

9.1. The User accepts that the Content they enter on or link to the Platform is lawful, does not infringe the copyright, related rights, trademark, design, patent, personality, privacy or other rights of third parties, and that they hold the rights or authority necessary to share that Content.

9.2. Ownership of the rights in works and performances contained in demos, performances, images or other materials shared by the User as part of an application is not transferred to GKK under this Agreement. Acceptance of this Agreement does not amount to a transfer of economic rights to GKK, or to the grant of a general, perpetual or unlimited licence, in respect of the User's existing or future musical works, performances, sound recordings, demos or other intellectual creations.

9.3. The User permits the demos, performances, images or other materials submitted as part of an application to be processed only to the extent necessary to receive the application, store it technically, allow the authorised organising team and the jury to listen to or view it, and evaluate it. This permission does not amount to public release of the material, commercial use, adaptation or arrangement, the grant of a general licence to third parties, or a transfer of the User's copyright or related rights. Uses of the works produced during the competition, such as recording, adaptation, promotion or release on digital platforms, are governed separately.

9.4. The User accepts that any legal liability arising from the use of unlicensed samples, beats, backing tracks, third-party recordings, images, trademarks or other protected elements rests with the User to the extent of their own acts and fault. GKK's statutory liabilities are reserved.

9.5. GKK may temporarily restrict access to Content, remove it from the evaluation process, or apply other measures required by law where the Content is assessed as manifestly unlawful, where a reasonable and specific notice of third-party rights infringement is received, where system security is endangered, or where action is required by a decision or request of a competent authority. Where possible and legally permissible, the User is informed of the action taken; the statutory rights of the individuals concerned to apply and to object are reserved.

ARTICLE 10 - INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS IN THE PLATFORM

10.1. The intellectual and industrial property rights in the Platform's software, interface, database structure, design, texts, visual and audio elements, logos, trademarks and other content belong to the respective rights holders and/or to GKK under applicable law and contracts.

10.2. The User is granted a limited, non-transferable and non-exclusive right to use the Platform solely for personal membership and event purposes. This provision does not confer ownership of, or the power to dispose of, any trademark, work, design, software or other intellectual or industrial property right.

10.3. Except where expressly permitted by law, the User may not reproduce, modify, publish, distribute, commercially exploit or allow third parties to use elements of the Platform without the permission of GKK or the relevant rights holder.

ARTICLE 11 - PERSONAL DATA, PRIVACY AND COOKIES

11.1. The procedures and principles governing the processing of the User's personal data are explained in the KVKK Privacy Notice, prepared under Personal Data Protection Law No. 6698 and related legislation.

11.2. Acceptance of this Agreement is not a general or unlimited declaration of explicit consent to the processing of personal data. Where a processing activity relies on explicit consent, that consent is obtained separately from the privacy notice and from acceptance of this Agreement.

11.3. Information about the cookies and similar technologies used on the Platform is set out in the separately published Cookie Policy. For non-essential cookies, a separate preference/consent mechanism is applied where required by law.

11.4. If the User closes their account, or membership ends for any reason, the Account is closed to active use. Closing the Account does not mean that the personal data and transaction records GKK must retain under applicable law are simultaneously and entirely destroyed.

11.5. From the date the Account is closed, identity, contact, membership, application and transaction/security records that must be retained for the resolution of disputes, the establishment, exercise or protection of a right, proof of membership and application transactions, the prevention of duplicate or false memberships and similar misuse, the provision of information security, and the fulfilment of GKK's legal obligations may as a rule be kept for a maximum of two (2) years. Where the relevant legislation provides for a longer retention period, or where longer retention is necessary because of an ongoing dispute, review or investigation, or for the establishment, exercise or protection of a right, only the necessary data may be kept for as long as that legal ground persists.

11.6. The two (2) year retention period does not provide a basis for using the data of a User whose account has been closed for active membership, profile creation, promotion, or any other purpose incompatible with those set out in this article. Where the reason for processing ceases earlier and there is no further need to retain the personal data, that data may be deleted, destroyed or anonymised sooner. Upon expiry of the retention period or the relevant legal ground, personal data is deleted, destroyed or anonymised in accordance with Personal Data Protection Law No. 6698 and related legislation. Details of data categories and retention periods are set out in the KVKK Privacy Notice.

ARTICLE 12 - COMMUNICATIONS AND NOTIFICATIONS

12.1. Notifications required for membership, account security, application status, event organisation, changes or performance of the service may be sent to the User's registered e-mail address or telephone number, by SMS, or through in-Platform notification channels.

12.2. For commercial electronic messages relating to events, campaigns, promotions or announcements, separate consent is obtained from the User where required by applicable law. The User may withdraw such optional messaging consent through the relevant channels.

12.3. The User is responsible for keeping their registered contact details up to date. Consequences arising from GKK being unable to reach the User because changes to contact details were not updated on the Platform rest with the User, to the extent GKK is not at fault.

ARTICLE 13 - OPERATION, MAINTENANCE AND SECURITY OF THE SERVICE

13.1. GKK takes reasonable technical and administrative measures to keep the Platform running securely and functionally; it may temporarily suspend all or part of the services for maintenance, updates, security or infrastructure work.

13.2. Planned maintenance and changes that significantly affect the service are announced in advance on the Platform where circumstances permit. Advance notice may not be possible for urgent security interventions or outages beyond GKK's control.

13.3. GKK is liable for outages and delays caused by third-party infrastructure or connectivity services in proportion to its own fault. Nothing here may be construed as relieving GKK of liability for gross fault.

ARTICLE 14 - SUSPENSION AND TERMINATION OF MEMBERSHIP

14.1. The User may request termination of their membership through the account closure method offered on the Platform or through the application channels announced by GKK.

14.2. GKK may temporarily suspend the account or terminate the membership, depending on the nature of the incident, in cases of false membership information, allowing a third party to use the account, conduct that threatens system security, use of multiple or misleading accounts, infringement of third-party rights, manipulation of the competition or Platform processes, or material breach of this Agreement.

14.3. Where the breach is capable of being remedied, GKK may give the User a reasonable opportunity to put it right, taking into account the urgency of the situation and the security risk. In cases of clear security risk, fraud, serious rights infringement or unlawfulness, measures may be applied without prior notice.

14.4. Termination of membership does not affect rights and obligations that arose before the termination date, legal claims, record retention obligations, or provisions that by their nature must continue to apply after termination.

ARTICLE 15 - AMENDMENTS TO THE AGREEMENT

15.1. GKK may amend this Agreement due to changes in legislation, changes in the technical or functional structure of the Platform, security requirements, or updates to the scope of the service.

15.2. Amendments that may have a substantive adverse effect on the User are notified to the User through the Platform and/or the registered contact channels before they take effect. Where legislation or the nature of the amendment so requires, separate electronic acceptance of the updated Agreement is obtained from the User.

15.3. Amendments are not applied retroactively in a way that removes the User's vested rights. The current text of the Agreement is published on the Platform with its effective date and version information.

ARTICLE 16 - FORCE MAJEURE

16.1. Natural disasters, war, acts of terrorism, widespread epidemics, general communication or power outages, decisions of public authorities, cyber attacks, and similar events beyond the parties' reasonable control that cannot be prevented despite due care may be treated as force majeure.

16.2. Obligations affected by force majeure may be suspended, limited to the duration and extent of its effect. Where circumstances permit, GKK informs Users about significant service interruptions and makes reasonable efforts to restore the service.

ARTICLE 17 - LIABILITY

17.1. The parties shall perform their obligations under this Agreement in accordance with applicable law and the rules of good faith.

17.2. The User is liable under general legal principles for damage they directly cause through false information given through their own fault, unauthorised use of the account, Content infringing third-party rights, or unlawful use of the Platform.

17.3. GKK's statutory liabilities, data security obligations and liability arising from its gross fault are reserved. This Agreement may not be construed as a provision that excludes or limits liability contrary to mandatory provisions of law.

ARTICLE 18 - GOVERNING LAW AND DISPUTE RESOLUTION

18.1. The laws of the Republic of Türkiye apply to the formation, interpretation and performance of this Agreement.

18.2. The competent and authorised judicial bodies for disputes arising from this Agreement are determined in accordance with applicable law. Where the User is considered a consumer in a transaction under Consumer Protection Law No. 6502, their rights arising from the consumer arbitration committee, the consumer court and other mandatory application/jurisdiction provisions are reserved.

ARTICLE 19 - NOTICES AND CONTACT

19.1. GKK's current identifying and contact details are published on the Platform and through the relevant official channels. The User may send notices concerning membership and Platform transactions through the support/contact channels shown on the Platform.

19.2. GKK's corporate address and Platform details as at the date of this Agreement are set out in the Document Information table on the first page of this document. If the official contact details change, the current information published on the Platform prevails.

ARTICLE 20 - ENTRY INTO FORCE

20.1. This Agreement consists of twenty (20) articles and enters into force when the User accepts it electronically and completes the membership process.

20.2. The User declares that they were able to read the terms of the Agreement, had the opportunity to learn its content, and accept the terms that apply to the membership relationship.

20.3. If any provision of this Agreement becomes wholly or partly invalid or unenforceable under mandatory legislation, this does not automatically affect the validity of the remaining provisions. The relevant mandatory statutory provision applies in place of the invalid or unenforceable provision.
